Welcome to Cutscene Replay. These Terms & Conditions govern your use of the Cutscene Replay website, desktop application, account services, free trial, paid subscriptions, downloads, updates, and support. By accessing the website, creating an account, starting a trial, purchasing a subscription, or using the software, you agree to these terms. If you are using Cutscene Replay on behalf of a business or organisation, you confirm that you have authority to accept these terms on its behalf. If you do not agree, you must not use the website or software.

1. About Cutscene Replay

Cutscene Replay is a Windows desktop application designed to capture recent gameplay, screen or window content, camera, media, and audio sources, and to create horizontal and vertical clips, separate source recordings, and editable export files for supported editing workflows.

Cutscene Replay is a trading name of Mr M. Albon, a sole trader established in England. Throughout these terms, “Cutscene Replay” refers to the software, website, and related services, while “we”, “us”, and “our” refer to Mr M. Albon trading as Cutscene Replay. “You” refers to the visitor, account holder, trial user, subscriber, or other authorised user of Cutscene Replay. Our business and contact details are set out in section 11.


2. Use of the Website and Software

You may use the website and software only for lawful purposes and in accordance with these terms. You must not damage or disrupt the website or service, attempt unauthorised access, introduce malicious code, interfere with licensing or security systems, use the software to infringe another person’s rights, or use Cutscene Replay in connection with unlawful surveillance, harassment, fraud, or other illegal activity.

You are responsible for ensuring that your computer, operating system, graphics drivers, storage, permissions, capture sources, and third-party applications meet the stated requirements and are configured correctly. Cutscene Replay is a content-creation tool and must not be treated as the sole archive of important footage or as a guaranteed, safety-critical, or uninterrupted recording system.


3. Software Licensing and Subscriptions

3.1 Free Trial

Where offered, the Cutscene Replay free trial lasts for the period shown at sign-up, currently 14 days unless another period is clearly stated. A valid payment method may be required to begin the trial. Trial eligibility and any feature limitations will be displayed at the point of sign-up, and we may refuse or end repeated, fraudulent, or abusive use of trial offers.

Unless you cancel before the trial ends, the trial will automatically convert to the monthly or annual paid subscription selected during sign-up and the applicable fee will be charged to your payment method. The precise trial end date and first payment date will be shown during checkout or in your order confirmation or account area.


3.2 Paid Subscriptions and Proprietary Licence

Cutscene Replay is licensed rather than sold. While your subscription is active and paid, we grant you a limited, non-exclusive, non-transferable, and revocable licence to install and use the software for your own personal or commercial content-creation activities, subject to the user, account, device, activation, and feature limits stated for your plan.

Subscriptions are billed in advance on a monthly or annual basis, according to the option selected at checkout, and automatically renew for the same billing period until cancelled. The price, billing frequency, taxes, trial terms, and renewal arrangements applicable to your purchase will be shown before you place the order. You are responsible for keeping your billing information current and for any taxes or charges that are not collected by us at checkout.

We may change subscription prices for future billing periods by giving reasonable advance notice. A price change will not alter a billing period that you have already paid for. If you do not accept a future price, you may cancel before the new price takes effect.

You must not sell, rent, sublicense, redistribute, publicly share, or commercially provide access to the software or your account; share a personal licence between unauthorised users; bypass usage, activation, or subscription controls; copy or adapt the software to create a competing product; or reverse engineer, decompile, or disassemble it except to the limited extent that applicable law expressly permits.


3.2.1 Licence Validation and Compliance

An internet connection may be required for initial activation, account access, updates, and periodic licence validation. Cutscene Replay may check whether your subscription and licence remain valid. If validation cannot be completed, a payment fails, a subscription expires, or the licence is suspended, paid features may become unavailable immediately or after a limited validation period, including when the application is next restarted.

Where we reasonably identify licence sharing, tampering, fraudulent payment activity, abusive trial use, unauthorised redistribution, or another material breach, we may restrict activations, suspend access, require the issue to be corrected, or terminate the licence. Where appropriate and lawful, we will provide a reasonable opportunity to resolve an accidental or remediable issue before permanent termination.


3.3 Updates, Availability, and Support

An active subscription may include access to software updates, downloads, licence services, and standard support. Updates may be delivered directly, through the Cutscene Replay website, or through a third-party store such as the Microsoft Store. Third-party store downloads and purchases may also be subject to that store’s terms.

We may add, remove, replace, or modify features to improve performance, security, compatibility, or the overall service, and minimum system requirements may change over time. We do not guarantee that every feature will remain compatible with every item of hardware, graphics driver, game, capture source, editing application, or third-party service.

We will provide the service and support with reasonable care and skill. Unless a separate service level is expressly agreed, we do not guarantee a particular response time, resolution time, release schedule, or uninterrupted availability. Nothing in this section limits rights that cannot lawfully be excluded.


4. Payments, Cancellation, and Refunds

You may cancel a trial or subscription at any time using the account controls or cancellation method made available for your purchase. Cancelling a trial before its stated end date prevents the first subscription charge. Cancelling a paid subscription prevents future renewals, and access will normally continue until the end of the billing period already paid for. Purchases made through the Microsoft Store or another third-party marketplace may need to be cancelled and managed through that marketplace.

Payments are not normally refunded solely because you did not use the software, forgot to cancel, changed your mind after access began, or experienced a problem caused by unsupported hardware, third-party software, or an environment outside our control. However, this does not affect your statutory rights. Where Cutscene Replay is faulty, materially misdescribed, or not supplied with reasonable care and skill, you may be entitled to repair, replacement, repeat performance, a price reduction, cancellation, or a refund as required by applicable law. Any applicable cooling-off rights and the consequences of requesting immediate access to digital content will be explained where required during purchase.


5. Recordings, Exports, and User Content

5.1 Your Content and Responsibilities

As between you and us, you retain your rights in recordings, layouts, projects, and other content that you create using Cutscene Replay. These terms do not give you ownership of games, music, broadcasts, images, performances, trademarks, or other third-party material captured or included in that content.

You are responsible for obtaining any permissions, licences, notices, and consents required to record, process, edit, publish, stream, or otherwise use content and personal data. You must comply with copyright law, privacy and data-protection obligations, platform rules, game publisher terms, employment or venue policies, and any other requirements that apply to your recording activity.


5.2 Local Files, Storage, and Capture Reliability

Cutscene Replay’s recording and export functions are intended to process and save media on your device or to a location that you select. You are responsible for selecting a suitable storage location, maintaining adequate free space, protecting and backing up exported files, and testing your configuration before relying on it for an important recording. Any online account, licensing, diagnostics, analytics, or support data is handled in accordance with our Privacy Policy.

Capture and export results can be affected by hardware performance, operating-system behaviour, drivers, permissions, storage speed, source applications, codecs, encoder availability, system load, and third-party changes. We do not guarantee that every requested moment, source, frame, audio sample, or export will be captured or completed without interruption. You should keep independent copies of important source material and review exported footage promptly.


6. Intellectual Property and Copyright

The Cutscene Replay software, website, branding, interface, designs, graphics, text, documentation, installers, updates, and underlying code are owned by or licensed to us and are protected by intellectual-property laws. Your licence grants permission to use the software; it does not transfer ownership of Cutscene Replay or its intellectual property to you.

You may not copy, publish, distribute, modify, create derivative software from, remove proprietary notices from, or commercially exploit Cutscene Replay except as expressly permitted by these terms or by law. Nothing in these terms claims ownership of your original recordings or other user-created content.


7. User Accounts and Termination

You must provide accurate account information, keep your login and payment details secure, and promptly notify us if you suspect unauthorised access. You are responsible for activity carried out through your account and must not allow another person to use it where this would exceed the limits of your subscription or licence.

We may suspend or terminate an account, trial, subscription, or licence where reasonably necessary because of fraud, chargeback abuse, security risk, unlawful use, serious or repeated breach of these terms, or failure to pay. On expiry or termination, your right to use paid features ends, but provisions concerning intellectual property, liability, payment obligations, and disputes continue where relevant.


8. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot lawfully be excluded, or any other liability that the law does not permit us to limit. If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill, but not for loss that was not reasonably foreseeable or for business losses arising from consumer use.

If you use Cutscene Replay wholly or mainly for business purposes, then, to the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill, anticipated savings, or data. Subject to liabilities that cannot lawfully be limited, our total aggregate liability arising from Cutscene Replay in any 12-month period will not exceed the subscription fees paid by you for Cutscene Replay during the 12 months immediately preceding the event giving rise to the claim.


9. Changes to These Terms

We may update these Terms & Conditions to reflect changes to Cutscene Replay, pricing or subscription arrangements, security requirements, business operations, or applicable law. Where a change materially affects an active paid subscription, we will take reasonable steps to provide notice before it takes effect. The updated terms will apply from the stated effective date, and you may cancel before a future renewal if you do not wish to continue under the revised terms.


10. Governing Law and Disputes

These terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory rights provided by the law of the country in which you live, and you may bring proceedings in the courts available to you under applicable consumer law. If you are acting in the course of business, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these terms or Cutscene Replay.
